In the 1860 census a Robert and Swanton Bateman of Canada were enumerated in the state prison in Jackson, Michigan. Their ages match this Robert and his brother and it is presumed it was likely they. Robert is said to be a carpenter by trade and 23 years of age. Although there is a record of Swanton, the younger brother, being pardoned in 1863, I have not found any record of a pardon being granted to Robert. This is believed to be the Robert who married Mary Elizabeth Smith, daughter of Jane Bateman and Matthew Smith, and lived in Kansas, although I have no proof of this relationship.
The 1875 Kansas state census indicates that Robert was born in Canada and had moved from Michigan to Kansas. In 1870 Robert and Elizabeth and their son Byron were living in Vienna tp, Pottawatomie county, Kansas; Robert's age is given as 33, supporting idea that he is the same Robert who was aged 23 and in prison in Michigan in 1860. Elizabeth was 22. Robert was a farmer. In 1880 census Robert is said to be aged 44 years, Elizabeth's age was 33 (Lincoln, Pottawatomie County, Kansas, NA Film #T9-0393, p. 389A). In the 1900 Census (Chandler, Lincoln County, Oklahoma: D 116, Sheet 6-B) Robert was 65, parents born Ireland; Elizabeth 52, father born Ireland, mother Canada; children still at home were Wallace B. 21, Hiddon 18, Winfield 16, Inez D. 11, all born Kansas. Robert had immigrated to the USA in 1858.
All US census records indicate born in 1835, but Canadian baptism record says 1837, although not baptised until 1851. Burial record gives dates as 10 Jan. 1835 to 1 May 1908 (find-a-grave website). However, death record says he was 71 which is consistent with a birth year of 1837.

John William Bateman

- Note: John was not living with the rest of his family on the 1851 census (actually recorded as of January 1852). He was probably the John Bateman, age 14, living with John Papineau and Catherine Bateman on Lot 12, 2nd Concession. The exact relationship between his father William and John P. is not yet proven.
John and Elizabeth lived in Lincoln Tp, Washington County Kansas at the time of the 1870 census, which indicated that their son John, then aged 2 years, had been born in Canada. This indicates that they moved from Ontario to Kansas between 1868 and 1870. The Jackson county, Kansas naturalization record for John W. Bateman, age 30 years, arrived 24 September 1868 is presumed to be this man. John and his family then returned to Ontario where their daughter Mary was born in 1876. They were in Caradoc Tp, Ontario for the 1881 census, and Elizabeth died there in 1883. John was left an inheritance by his aunt Louisa Bateman (nee Mills), who died in 1887. According to her will, at that time John was living in Smithland Iowa, an area where some related Batemans still live.
John later returned to Kansas and in 1900 was living with his daughter Mary in Lincoln, Pottawatomie county, Kansas. That census indicated he immigrated to the USA in 1870. The following death record is believed to be for this John:

John's wlil is available on ancestry.com: Original will indicates he was a resident of Little Sioux twp, Woodbury county, Iowa, dated 23 Feb. 1893. A codicil indicates he was then a resident of Jackson county, Kansas. This will names his children William Swanton, John, Jane, David Newton and Mary Ester. The codicil, dated 19 Jan. 1895, names his brother George as his executor and leaves the vast bulk of the estate to Mary Ester. Swanton Bateman

In the 1860 census a Robert and Swanton Bateman of Canada were enumerated in the state prison in Jackson, Michigan. Their ages match this Swanton and his brother and it is presumed it was likely they. In December 1859 Swanton was sentenced to 10 years in prison for robbery. The 1860 census indicates his age was 19 and occupation was "Cons or Com Laborer." May 19, 1863 he was pardoned by Governor Austin Blair ( http://www.rootsweb.com/~miingham/Pardons4.html ).
There is also a record of a Swanton Bateman, age 22, enlisted in the army in Detroit 25 May 1864--probably also this Swanton--he fought for the Union in Company H, 15 Michigan Infantry Unit. He remained a private at the time of his discharge. No further information about Swanton is known. I have not attempted to find more detailed military records to follow this up. Wikipedia indicates that the regiment was disbanded 18 August 1865. It was engaged in the following: Battle of Shiloh, Battle of Corinth, Siege of Vicksburg, Battle of Resaca, Battle of Kennesaw Mountain, Siege of Atlanta, Sherman's March to the Sea (aka Savanna Campaign) and Battle of Bentonville. Only the latter three of these occurred after May 1864. See Wikipedia for more info on these campaigns.

If so, had been married to wife Margaret (born Ireland 1842) for 14 years, so that date fits, even if birth date is out? Census indicates he had immigrated to the USA 34 years earlier. However, that could also be George C. Bateman who was born March 1845. But his wife doesn't fit so well--truly a dilemma to be sorted out!
Administration papers for estate of brother John indicate that George died about 23 March 1907.

Richard moved to near Smithland, Iowa after his marriage and bred Belgian horses there until 1895. The family is listed in the 1895 Iowa state census in Woodbury county, and includes Richard 49, Christina 32, Erwin 9 and Chasie 4.
In 1880 Richard and his family lived in Little Sioux, Woodbury County, Iowa. Richard was said to be a farmer, aged 32, born in Canada. The family is also found there in the 1895 Iowa state census, when Richard was said to be 49, Christina 32, Ervan 9 and Chasie (Katie) 4. Also in Little Sioux at that time were his uncle Thomas Bateman (58--also enumerated with his family in Ontario in 1901)) and cousins John (26) and David (22). This was about the time that Richard and Christina separated.
In the 1900 U.S. Census, Richard had returned to Kansas, and was living in the Pottawatomie Indian Reservation, Jackson county. It stated that he was born in July, 1847 in "Canada (Eng)" and immigrated to the USA in 1866. His parents came from Ireland. This census also listed his second wife, Mary, born May 1841 in Ohio, and whose parents came from Virginia. At the time of the census, they had been married 2 years. In 1910 and 1920 Richard and his third wife Amanda lived in Cedar tp, Jackson county, Kansas. In 1920 his grandson, George Irish (13) was living with them.
I was told Richard had died of lockjaw in 1916, where he was farming on the Pottawatomie Indian Reservation in Jackson County, Kansas, and was subsequently buried. However, I have found him listed in the 1920 census still in Mayetta, Cedar tp, aged 74.
